Emporia State University has moved to have a federal court dismiss a civil rights violation lawsuit filed earlier this fall.
ESU has filed a motion to dismiss Eric Cannon’s lawsuit that was filed in September. A decision on that motion is pending, but Judge Rachel Schwartz has agreed to a separate motion from ESU to stay both discovery and further proceedings until further notice. ESU says Cannon hasn’t officially stated claims on several of the lawsuit counts. It also says allowing discovery now is a waste of resources.
Cannon, a former custodian, says his rights as a gay man were violated under Title VII of the Civil Rights Act of 1964 and as a disabled person under the Americans with Disabilities Act of 1990. Cannon says he has multiple health issues that made it difficult to perform daily tasks and he was harassed on several occasions while ESU ignored its own human resources policies about sexual orientation as well as medical advice when presented.
