Jury trial was set to begin Monday for an Emporia man accused of battery on local law enforcement and other counts. Instead the case against Seth Michael Torres goes to sentencing after a plea agreement was reached late last week.
Torres, age 36, was initially charged with aggravated battery on law enforcement, interference with law enforcement and criminal damage to property after allegedly using a box cutter against an Emporia Police officer in late June, as well as resisting arrest from several officers during the incident.
Last week, Torres pleaded no contest to attempted aggravated battery on law enforcement by using a deadly weapon. Torres could face up to 46 months in prison and up to 24 months probation at sentencing Feb. 18.
