An Emporia man accused of using a vehicle to threaten another person and damage property near downtown Emporia in one case and choking the same person in another will return to court over the next two weeks.
Seth Giroux has a motion hearing April 29 ahead of a pretrial hearing May 7 in the case dating back to mid-March, when he allegedly used a pickup to chase down a woman through at least two lawns March 11. He is also charged with damaging property at Emporia First Baptist Church and at least one private residence.
Lyon County Judge Laura Miser is currently considering prosecution motions for a no-contact order with endorsed witnesses and for returning the truck Giroux allegedly drove during the incident to the alleged victim in the case. Judge Miser has already denied a defense motion to modify bond.
Giroux remains charged with aggravated assault – bodily harm with a deadly weapon, as well as aggravated assault, criminal damage and driving violations in this case.
The second case involves allegations Giroux tried to choke the woman during an incident in mid-February, as well as battery and threat incidents in January. That case has Giroux charged with aggravated battery, battery and criminal threat. Giroux was originally set for a preliminary hearing Wednesday, but that was delayed to May 6 due to a scheduling conflict for defense attorney Rand Simmons. Lyon County Judge Doug Jones approved the delay and also approved Simmons’ motion for discovery before setting the new hearing date.
