A man accused of murder in a Lyon County case has now filed a motion detailing why he has changed his plea.
Alexei Perez-Ricardo is now asserting self-defense immunity, saying he got into a fight with Adolfo Callejo-Viniegra last year. Perez-Ricardo says Callejo-Viniegra hit him in the head with a freshly-opened beer can as part of the argument. Perez-Ricardo says he pulled out a pocket knife and poked at Callejo-Viniegra once, cutting the victim on the arm.
Perez-Ricardo was set to be sentenced for second-degree murder, but his defense attorney, Rand Simmons, filed a motion to withdraw a no-contest plea.
The next hearing in this case is Oct 22.
Meanwhile, an Emporia woman charged in a separate alleged stabbing incident — along with aggravated escape in another case — was recently approved for medical furlough.
Judge Jeff Larson granted Makayla McCray a furlough late last month to deliver a child. The agreement had McCray returning directly to Newman Regional Health following her medical discharge.
McCray is charged with one count of aggravated battery after allegedly using a knife against Shakir Williams back in May. A pretrial hearing is set for July 24.
As part of another case, McCray faces single counts of aggravated escape from the Lyon County Detention Center; possession of cocaine, marijuana, synthetic marijuana and paraphernalia; and attempted interference with law enforcement after an alleged incident last month. McCray is now set for a bond modification hearing at 1:30 pm Monday.
