A man originally accused of child abuse by choking was not sentenced as scheduled Friday because, according to Lyon County court documents, he did not appear at his hearing.
Ernest Donale Emerson Rayton had pleaded no contest to an alternate count of aggravated battery – physical contact with a deadly weapon this past February. He was set for sentencing Friday. As a result, Rayton forfeits bond and a bench warrant will be activated as of 5 pm Monday.
Rayton was initially charged with child abuse, with alternates of aggravated battery – physical contact with a deadly weapon and aggravated battery – bodily harm with a deadly weapon, after an alleged incident involving a then-15-year-old in November 2024.
