As court proceedings begin in federal court against a man accused of distributing methamphetamine in the Kansas City metro area and triggering both a law enforcement pursuit and an officer-involved shooting in Chase County two months ago, the Chase County Attorney’s Office says proceedings will not start against the troopers involved in the suspect’s ultimate arrest.
Chase County Attorney Bill Halvorsen says he has reviewed the Kansas Bureau of Investigation in the case of Dustin Schultz-Bergin and the two troopers who confronted him Jan. 23, first at the Kansas Turnpike’s Matfield Green service area and later along the highway 10 miles northeast of the service exit. Halvorsen says the troopers’ actions were “reasonable and legally justified,” so he will not press charges against them.
Authorities have said Schultz-Bergin was armed when he was shot at least once by a trooper. He was also bitten more than once by a K-9 unit helping with the case.
Halvorsen says it is likely he will file charges against Schultz-Bergin, but a final decision has not been made.
Schultz-Bergin is currently facing federal charges of possessing methamphetamine with intent to distribute and being a felon in possession of a firearm.
