A federal grand jury has now indicted an Olathe man who fled from the Kansas Highway Patrol and was shot during a confrontation in late January.
The US Attorney’s Office says Dustin Schultz-Bergin is charged with one count of possession with intent to distribute methamphetamine and another count of being a felon in possession of a firearm.
Authorities say troopers tried to arrest Schultz-Bergin at the Kansas Turnpike’s Matfield Green service area Jan. 23. Instead, Schultz-Bergin allegedly fled and led a chase before his car was disabled 10 miles north of the service area. Schultz-Bergin was armed and got into a confrontation with troopers before he was shot at least once and also bitten several times by a K-9 unit.
The Drug Enforcement Administration now says Schultz-Bergin had more than seven pounds of meth in his car along with a handgun.
The indictment supersedes a prior complaint announced Feb. 21 that originally charged Schultz-Bergin with one count of possession with intent to distribute. If convicted, he faces at least 10 years in federal prison and a $1 million fine on the meth distribution charge as well as a 10-year prison term and a $250,000 fine on the firearm charge.
The Kansas Bureau of Investigation has sent its findings in the trooper-involved shooting aspect of the case to the Chase County Attorney’s Office. Formal charges are pending.
