A bench warrant out of Lyon County District Court has been issued for the arrest of a man accused of stabbing another man in east Emporia last fall.
Cody Risner failed to appear for a final pretrial hearing in county court Wednesday afternoon. Following his failure to appear, Judge Lee Fowler issued a bench warrant for Risner’s arrest.
Risner was out on bond. Trial was scheduled to begin next Monday in the case. According to County Attorney Marc Goodman, the case has been continued until further notice.
Risner is accused of stabbing Tyler Ray Smith after an argument in the 1200 block of Triplett Drive on Oct. 1 and has been charged with single counts of aggravated assault and aggravated battery. Risner has denied both the confrontation and stabbing Smith.confrontation and stabbing Smith.
