A man accused of rape in an Emporia case early last year has been sentenced to probation after a plea agreement on a lesser charge earlier this year.
Edgar Gilberto Gonzalez, 47, pleaded no contest to a single count of aggravated battery in place of the rape count. Gonzalez was also facing a count of aggravated criminal sodomy, which was dropped as part of the agreement.
Gonzalez was sentenced to two years of probation. There is an underlying 11-month prison term, so any probation violation could automatically send Gonzalez to prison.
