A defense motion in a case of a suspected drug dealer in Emporia have been denied, while a prosecution motion in the case has been approved.
Raul Magallanez was seeking a change of venue in his marijuana distribution case, but that was denied last week. On Tuesday, Judge Jeff Larson approved a prosecution motion to bring more evidence to the table.
Officially, Magallanez is charged with marijuana distribution and paraphernalia possession with intent to manufacture, plant or cultivate. The charges also effectively accuse him of violating parole after he pleaded no contest to two counts of aggravated indecent liberties in 2011.
Co-defendant Marquise Richardson faces 13 counts, including cocaine and marijuana distribution.
