Two men face preliminary hearings in Lyon County District Court on Wednesday on drug distribution charges. One is an Emporia man convicted seven years ago of sexual activity with a teenager over a decade ago.
Marquise Richardson is facing 13 counts, including cocaine and marijuana distribution; possession of paraphernalia with intent to manufacture, plant or cultivate; illegal use of a communication facility or device; and interference with law enforcement.
Raul Magallanez, Jr., 43, is accused of marijuana distribution and possession of paraphernalia with intent to manufacture, plant or cultivate.
Court documents indicate the case developed after several controlled buys of drugs by Emporia Police in late October. Officers say nearly 100 grams of pot were collected as part of three separate buys before Richardson was arrested Oct. 26. He allegedly fled and resisted arrest before he was captured.
Authorities say the investigation then led to Magallanez’s car, which allegedly had 50 grams of marijuana under the seat but he denied knowing where the drugs came from. Later, Richardson’s belongings were searched, leading to the alleged discovery of seven bags of marijuana weighing 230 total grams and 60 bags of cocaine weighing over 100 grams total. Officers say paraphernalia and money were also seized.
In Magallanez’s case, he’s accused of violating parole. Magallanez was first convicted in 2007 on over 50 counts of sex abuse, including rape, aggravated criminal sodomy, aggravated indecent liberties and sexual exploitation. However, the Kansas Court of Appeals reversed the original verdicts in 2010, citing the cumulative effect of procedural errors during trial. Magallanez then pleaded no contest in 2011 to two counts of aggravated indecent liberties.
Richardson has a bond modification hearing at 1:30 pm Wednesday, followed by a preliminary hearing at 2 pm. Magallanez has a preliminary hearing at 2:30 pm.
