Nicholas Faglie is a free man after his aggravated battery case was dismissed in Lyon County District Court this week.
Faglie was originally convicted after an incident at Charlie’s Place, where he allegedly punched a man and knocked him out in January 2016. However, the Kansas Court of Appeals sent the case back to Lyon County, saying a reasonable jury could have said Faglie was not the initial aggressor and did not use excessive force during the fight.
The appellate court panel reversed the aggravated battery conviction and vacated the resulting sentence. It also sent the case back to district court for a new trial.
Lyon County Attorney Marc Goodman says the case was dismissed because Faglie had already served his 16-month sentence and the alleged victim now can’t be located.
