An appeal is coming after sentencing was handed down in a burglary case that developed several years ago.
On Thursday, Joseph Paul Jones was sentenced to 34 months in prison. Jones entered a plea agreement in January, where he pleaded no contest to a single count of non-residential burglary and the remaining 39 counts against him were dismissed.
Jones had been accused of burglarizing over a dozen local businesses in the west half of Emporia in late April and early May 2014.
Defense attorney Rand Simmons tells KVOE News Jones believes the court made an error on the amount of restitution he was ordered to pay and another error regarding the determination of his criminal history score.
As it currently stands, Jones’ Lyon County sentence will run consecutively to sentences for similar activity in Reno County and also Greene County, Mo.
