The man accused of killing a well-known Emporian during a high-speed wreck last month has a hearing in Lyon County District Court on Monday.
Devawn Mitchell, 23, has an attorney review at 1:30 pm. Mitchell is accused of killing Steve Henry, an Emporia State Athletics Hall of Honor inductee, during a crash in the 1000 block of West Sixth on March 19. Authorities say Mitchell fled from law enforcement, even though officers had broken off a pursuit shortly before the crash.
During his first court appearance last month, Mitchell declined a court-appointed attorney, saying he was in the process of lining up legal representation. Once the attorney review is complete, Mitchell is tentatively set for a preliminary hearing April 19.
Mitchell currently faces a single count of first-degree felony murder with an alternate count of second-degree murder. He’s also facing one count of aggravated assault on a law enforcement officer and three charges of felony flee and elude.
