A preliminary hearing for a man accused of attempted murder and other charges after a pair of incidents in October 2020 will resume next month.
The hearing began Monday afternoon for Marcos Diaz, who was charged after one person was shot near Linn and Whildin before what authorities say was a home invasion robbery at 9 South Rural in October 2020. The hearing will now resume March 16.
Diaz faces eight counts. He’s charged with attempted second-degree murder, intentional, with an alternate count of aggravated battery. He’s also charged with single counts of aggravated robbery, conspiracy to commit aggravated robbery, aggravated child endangerment, contributing to a child’s misconduct and criminal discharge of a weapon as well as two counts of aggravated burglary.
Diaz is the last of three defendants in the case to start the court process. Lance Sutton was sentenced to over 20 years in prison, while Kenneth Hopkins received 29 months.
