A motion to dismiss charges against one of the defendants in the Jesus Avila murder case was presented in Lyon County District Court Friday morning.
Lyon County Judge Lee Fowler ultimately denied the request made by legal counsel representing Armando Nunez. Nunez will next appear inside district court for a continued motions hearing on Apr. 28 at 10 am.
Nunez is one of six individuals charged in connection to the 2017 murder of Avila whose body was found in a burned-out vehicle near Roads 160 and T southeast of Emporia in September of that year. Nunez is charged with aggravated robbery, arson, interference with law enforcement and theft.
He was set to begin trial on May 2 with a backup date of Jun. 13 following hearings in January.
