Trial is coming this spring in Lyon County’s first notable fentanyl distribution case.
As part of a hearing Wednesday, Terry Don Cummings requested a bench trial instead of the traditional jury trial. The trial will be May 18 before Judge Lee Fowler.
Cummings is accused of distributing around 200 false oxycontin pills as part of an alleged incident near Emporia in January 2022.
Meanwhile, jury trial is now set to begin May 22 in the drug distribution case of Austin Levi Buckridge after a hearing Wednesday.
Buckridge is accused of distributing up to 450 grams of marijuana and up to 100 grams of cocaine, as well as possessing paraphernalia, after an alleged incident this past July.
Also, a motions hearing is now on the Lyon County docket as the case against Christopher A Diaz moves forward.
The hearing at 2:30 pm April 4 will determine whether evidence connected to a search warrant can be admitted. Diaz’s defense attorney, Chase Miller, has asked for the evidence to be suppressed.
Diaz is currently charged with distributing up to 450 grams of marijuana, as well as possession of cocaine, hydrocodone, psilocybin and paraphernalia following an alleged incident in May 2022. A status hearing is tentatively set for April 12.
