A motions hearing is coming Thursday in an Emporia rape case.
Prosecutors in the case against Dominik Simunovic are seeking to delay trial, currently set to begin April 29. Prosecutors say several key witnesses can’t attend for trial as it is currently scheduled, so they are requesting an Aug. 28 start.
The former Emporia State tennis player is facing single counts of rape and aggravated criminal sodomy after an alleged incident this past October. Both counts have alternates alleging the victim was incapable of giving consent due to the presence of alcohol, drugs or other substances.
Thursday’s hearing is at 9 am.
