Lyon County District Court Judge Jeff Larson will decide later on a motion to delay the rape trial against former Emporia State tennis player Dominik Simunovic, but he took action on several motions requests during a hearing this week.
Larson approved state and defense motions in limine, disallowing improper statements at certain points of trial. He also approved state motions to exclude evidence of the victim’s previous sexual history, to consider Simunovic statements to law enforcement as voluntary and admissible and to endorse additional witnesses.
Before ruling on the state’s request to delay trial from April 29 to Aug. 28, Larson says Simunovic has to submit affidavits from his witnesses to specify whether they are available for a late-August trial as well as whether they will be in the United States. Larson will rule on delaying trial during a hearing at 9:30 am April 5.
