A Kansas Court of Appeals panel will hear a Lyon County civil lawsuit Tuesday.
Chief Judge Karen Arnold-Burger, Judge Amy Fellows Cline and Judge Kathryn Gardner will hear the case of Molly Ellis versus Kim McNeese and Flint Hills Technical College. Ellis filed an appeal after initially filing a lawsuit against the college and McNeese, the college’s former nursing director, saying she couldn’t finish her coursework due to religious reasons related to certain COVID-19 policies. Initially, Lyon County District Court ordered Flint Hills Technical College to give Ellis incomplete grades instead of failing grades. In July 2023, District Court granted the college’s motion for summary judgment — essentially ruling in favor of the college — and denying all Ellis’ motions in the process.
Ellis is appealing both the summary judgment and Judge Lee Fowler’s decision to deny a motion seeking to alter or amend the final judgement.
The Court of Appeals panel will hear the case at 9:30 am. It’s part of the court’s traveling docket in Manhattan.
