Kansas Congressman Derek Schmidt is pleased with a recent US Supreme Court decision to limit the authority of federal district judges to issue nationwide injunctions.
On KVOE’s Morning Show recently, the Second District Congressman said the high court ruling in Trump v CASA Inc et al should reset district court authority as it should be used.
Schmidt supports what is being called the No Rogue Rulings Act.
The root of Trump v CASA was the president’s push to end birthright citizenship, including an executive order earlier this year ordering all executive branch departments to not recognize children born to illegal immigrants as citizens, meaning the end of citizenship benefits for about 150,000 children born every year in the United States. Several federal district court judges issued preliminary injunctions. The Supreme Court’s 6-3 ruling says the universal injunctions, as they are called, exceeded judicial power.
Besides No Rogue Rulings, Schmidt has introduced the Wrongful Injunction Accountability Act, which would strengthen enforcement of existing laws where plaintiffs pay costs and fees if they get an injunction that is later deemed as unlawful.
