It doesn’t appear the Hardee’s restaurant in east Emporia is opening any time soon, if at all.
The restaurant at 1126 East 12th posted a short-term closure Dec. 19 due to “unforeseen maintenance” and followed that with a second announcement the following morning, saying the restaurant is closed until further notice. Since then, the restaurant signage has remained but the options on the menu board have been removed.
Spirit Master Funding X LLC of Boulder, Colorado, remains listed as owner of the property on Lyon County records. Heartland Restaurants, a subsidiary of Summit Restaurant Holdings LLC, is also listed as an owner on Lyon County records. Hardee’s recently filed a lawsuit for breach of contract against ARC Burger, which had bought 80 different Hardee’s restaurants two years ago after Summit filed for Chapter 11 bankruptcy, including Emporia’s location. Hardee’s says ARC Burger owes over $6 million in missed rent and other payments dating back a year.
