Four Seasons Apartments LLC is appealing a summary judgment in favor of former complex manager Alisha Hammond.
Four Seasons has said Hammond stole about $80,000 in tenant rental payments and misappropriated money orders during her time operating the apartment complex. It has been seeking the money as a third-party beneficiary after being owned by Dover Group and later by Eucalyptus.
The appeal involves, among other issues, an alleged misinterpretation of the record by Hammond’s attorney, Stuart Symmonds, as well as an abuse of discretion by Judge Jeff Larson by not reviewing a motion-to-settle journal entry. Four Seasons says the journal entry had inaccuracies that were left unaddressed. Four Seasons also says there was confusion as to documentation it filed with the court that led to Judge Larson ruling in Hammond’s favor based on incorrect information.
An appeal date has not been set.
