Sentencing has been continued in a Lyon County murder case.
Judge Jeff Larson approved a defense motion to continue sentencing in the case against Alexei Perez-Ricardo, thus allowing attorney Rand Simmons to subpoena witnesses. Sentencing is now June 18.
Besides ending the court proceedings, sentencing will also determine whether Judge Larson will approve Simmons’ motion for downward durational departure. Simmons says Perez-Ricardo has few memories of the night when he killed Adolfo Viniegra in late May 2025, also mentioning Perez-Ricardo’s no-contest plea to second-degree unintentional murder early this year and one prior felony as reasons Perez-Ricardo should get 314 months in prison — over 26 years in prison — instead of 416-460 months, or nearly 35 to over 38 years in prison.
Perez-Ricardo accepted a plea agreement in late January. Regardless of the length of the prison term, he has agreed to restitution and will have to register as a violent offender.
