The recall petition filed earlier this year against Emporia City Commissioner Erren Harter is now at an end.
The petition was circulated earlier this year by members of Emporia Neighbors United and became the focus of a legal battle between Commissioner Harter and Jay Vehige, Haley Bradford, Kathleen Lamb, Lyon County Legal Counsel Molly Priest and Lyon County Clerk Amie Jones, which concluded Thursday. The conclusion came after both parties agreed to an “Agreed Upon Order,” essentially an injunction that stated the petition can no longer be circulated moving forward.
Priest, who reviewed and deemed the petition legally sufficient earlier this year, stated the injunction does not mean future petitions seeking the same course of action cannot be circulated in the future.
KVOE News has reached out to both parties involved for comment on the situation. Harter declined comment, while KVOE News is awaiting a response from Vehige.
Legal matters surrounding Harter are not over quite yet; however, following the submission of a separate petition seeking to convene a grand jury to investigate allegations of misconduct in office levied against Harter. The grand jury is set to be empaneled on the 5th of this month.
